Family and Medical Leave Act
This act allows certain employees that meet the requirements and qualifications to take up to 12 weeks of unpaid time off. This act protects an employee’s job ensuring that when they return the employer must reinstate them with the same job or one equivalent.
Requirements:
- Companies must have 50 or more employees within 75 miles
- Over the past 12 months, employee must have worked at least 12 months or 1,250 hours for employer
Qualifications to use FMLA:
- for the birth and care of the newborn child of an employee
- for placement with the employee of a child for adoption or foster care
- to care for an immediate family member (spouse, child, or parent) with a serious health condition
- if employee is unable to work due to a serious health condition
